Terms of use.
The deal, in plain words: you buy or receive a licence, you use Kutara on your own machines, and your consumer rights stay yours.
1. Who you are dealing with
Kutara is made and sold by Orlando Gabriel Robertson, based in Victoria, Australia (“I” and “me”). These terms cover the website kutara.shop and the Kutara panel. By using either, asking for a free key, making an account or buying, you agree to them. If you do not, please do not use Kutara. You need to be 18, or have a parent’s or guardian’s permission.
2. What Kutara is
A panel that runs inside Adobe Premiere Pro on Windows. It is not made by Adobe, and you need your own copy of Premiere Pro under Adobe’s terms. Adobe and Premiere Pro are trademarks of Adobe Inc.
3. Your licence when you buy
When you buy, you get a personal, non-exclusive, non-transferable licence to install and use Kutara on computers you own or control, for your own work, including commercial work, for as long as you like. The licence is a block of text tied to your email address and your order. It is for you: one licence per person, so if a team needs it, each person buys one.
You agree not to:
- share, publish, sell or give away your licence, or use somebody else’s;
- remove, disable or work around the licence check, or help anyone else to;
- decompile or reverse-engineer Kutara, except to the extent the law lets you regardless of this clause;
- use Kutara to break another service’s terms or the law;
- automate the free-key form, the feedback form or the site’s API, or flood them.
4. Free test keys
Until 2026-12-31, the first 50 people who ask get a key for nothing. A test key is the same licence with an end date: it stops working after 2026-12-31, and it needs to check in with this site every 14 days or so, so keep the machine online now and then. I may end the test period early, or turn off a key that is being abused, and I do not have to keep offering free keys. A test key is provided for testing; things will break. When it ends, buying once replaces it.
5. Price and payment
The price is shown in US dollars and is what you pay. If a tax applies where you live and I am required to collect it, it is shown at checkout before you pay. Payment is taken by Stripe; I never see your card. Your licence and download appear on the receipt page the moment you pay and are emailed to you. Keep that email: it is the licence.
6. Updates
Updates are included and install themselves. I intend to keep improving Kutara, but I cannot promise a particular feature, a timeline, or that a future version of Premiere Pro or Windows will be supported. If I ever stop updating it, the version you have keeps working with your licence.
7. Refunds
14 days, any reason; after that, a fault I cannot fix is still a refund. The refund policy has the details. A licence that has been refunded or charged back stops working.
8. Accounts
An account is optional. If you make one, give accurate details, keep your sign-in details and two-step codes to yourself, and tell me if you think someone else has used it. You can delete it any time from Settings. I can suspend or delete an account that is used to abuse the site.
9. Clips, libraries and other people’s services
Kutara searches libraries run by other people: Openverse, Wikimedia Commons, Pixabay, Pexels and others, some of which need your own free API key. Everything it finds belongs to someone else and comes with its own licence: public domain, Creative Commons with or without a credit, or a library’s house licence. The panel shows the licence it is given and collects the credits due, but I cannot guarantee what a library reports, and it is your responsibility to check a clip’s licence before you publish, particularly for commercial or monetised work. Some Creative Commons licences forbid commercial use.
If you connect an AI provider (OpenAI or Anthropic) with your own key, that provider’s terms and prices apply and you pay them directly. AI-generated pictures can be wrong, biased, or resemble existing works; check them before you use them, and be aware that who owns an AI-generated image differs from country to country.
The Trends and Outliers pages show YouTube videos and numbers through the YouTube API Services; by using them you also agree to the YouTube Terms of Service. The scores, usual views, pace and engagement on Outliers are my own calculations from YouTube’s public numbers, offered as research, not as figures from YouTube or a promise of how a video will do.
10. Your work
Your videos, transcripts and files are yours. Kutara works on them on your computer and does not send them to me. Keep backups: editing software, this one included, can make a mistake with your timeline, and an undo is not a backup.
11. Feedback
If you send feedback or ideas, I can use them to improve Kutara without owing you anything, and without naming you unless you ask me to.
12. Ownership
Kutara, its code, design, name and mark, is mine. Your licence lets you use it; it does not transfer it. Openverse, Wikimedia Commons, Pixabay, Pexels, OpenAI and Anthropic are separate services and their names belong to them.
13. Availability
The site, the download, updates and licence check-ins are provided as well as one person can manage, and may be unavailable at times. A licence you have paid for keeps working offline whatever the site is doing.
14. Consumer guarantees and liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms takes those rights away, nor the equivalent rights of consumers in the EU, the UK or anywhere else they cannot be excluded.
Beyond what the law guarantees, Kutara is provided as it is. To the extent the law allows: I am not liable for loss of profit, data or business, or for indirect or consequential loss; my total liability to you is limited to the amount you paid for Kutara; and where the law lets liability for a failure be limited to supplying the software again or refunding it, it is limited to that. Free test keys are provided for testing and, to the extent the law allows, without warranty.
15. Ending the deal
I can revoke a licence that was refunded or charged back, posted publicly, or obtained by abuse, and I can stop serving anyone who abuses the site or its API. If I revoke a paid licence for any other reason, I refund it.
16. Changes
I may update these terms; the date at the top changes when I do, and the new terms apply from then. A change does not take away a licence you have already paid for.
17. Which law
These terms are governed by the laws of Victoria and the Commonwealth of Australia, and the courts of Victoria hear any dispute. If you are a consumer somewhere whose own rules or courts apply whatever a contract says, those still apply to you. If any part of these terms cannot be enforced, the rest still stands.
18. Contact
To get in touch about these terms, email orlando.grobertson@gmail.com or use the feedback page. You can also reply to any email you have had from Kutara.
